Definitions

The “ We”, “our”, “us” means Honeyrose Bakery Ltd as well as Kent & Fraser

The “Online shop customer” means you – the person or company named on the invoice

Other Terms or representations

All sales are subject to our conditions of sale as printed herein.

We shall not be bound by any variation waiver or addition to these terms unless the same is agreed in writing.

These conditions shall supersede and override any conditions of purchase stipulated by the online shop customer except and to the extent that any condition of purchase is agreed by us in writing.

Product Description and Quality

Due to the perishable nature of the goods sold, we are unable to make warranty as to the length of time for which goods will remain fit for consumption. We do give “Best Before Date” guidance on the products – the products should be consumed before that date. It is the responsibility of the online shop customer that such goods are kept in the manner prescribed by us and those rules prescribed for under Health and Safety regulations.

If the goods delivered do not meet our normal production standards, we will make such allowance as is appropriate. Our products and packaging are subject to change or substitution without prior notice.

All our Honeyrose brand products are certified organic; we use organic nuts, eggs, sesame seeds, eggs, butter, soya, and wheat as ingredients in our various processes. For this reason, we cannot guarantee that minute amounts of these allergens will not be present at some time in our products.

All of our Kent & Frasergluten-free brand products are certified gluten-free by Coeliac UK. Kent & Fraser products are not organic; they are gluten-free.

We are not a nut-free facility; we handle nuts in the bakery.

We are BRC Grade A certified, audited and inspected. Which is pretty darn good.

Pricing

The price quoted by us does not include delivery cost to the online shop customer, unless stated on our website, pricelist or otherwise agreed in writing.  The delivery price is added separately to the invoice at shopping cart checkout.

We determine the price of the product to the online shop customer. The price may vary dependent upon market conditions. If, as a result of any such conditions, the cost of the product should increase, then we retain the right to adjust the price to the online shop customer accordingly. We want our organic treats to be affordable to you and will do our utmost to contain price increases (we’ve done 1 in 7 years !).

Delivery

We rely on a courier service or the UK Royal Mail postal service to deliver our products to you, however, we can not guarantee delivery on a certain date, though best efforts will be made to get you your order on the targeted date of delivery.

Cancellation or Amendment of Orders

Order placed can be cancelled or amended up to 1pm, 2 working days before date of delivery. After this time, the order will have gone into production and it will be too late to cancel as our bakers will be up to their elbows in your dough.

If you wish to cancel your order, please email shop@honeyrosebakery.com as soon as possible, or call 020 8960 5567. There may be a cancellation fee charged if you do not give us at least 2 working days notice before the date of dispatch of the order and we have already incurred significant time, effort and expense in fulfilling your order.

In the event that you are unhappy with our service, please contact us within 5 days of receipt of goods and we will instruct you how and if  to return your order. We strive to answer any complaint within 1 business day of receiving it, and upon reviewing your issue, then apply a refund. Please be aware that you will be liable for any postage costs incurred as a result of returning items to us without our approval, and you should ensure that you obtain proof of postage if you send them back.

Force Majeure

In the event of contingencies beyond our control or for any reason interfering with the manufacture of goods then we shall not be liable for any loss caused by non delivery or delay or postponement of delivery.

Shipment and delivery dates are given in good faith but are only estimates made by us and are not guaranteed.

Loss, Damage and Claims

It is responsibility of the online shop customer to notify us or our agent of any damage, shortages or faulty goods by email,  fax,  or phone within 24 hours of receipt of goods from us or our agent. Credits will only be issued upon receipt of damaged or faulty goods returned to our office unless otherwise specified by us. Returned goods can be arranged for collection at a mutually convenient time.

Property and Risk

Ownership of the goods shall remain with us until full and final payment is made by the online shop customer and confirmed received by us.

Risk in goods shall pass to the online shop customer upon delivery or upon us issuing a delivery note / invoice in favour of the online shop customer.

Agents

Where the online shop customer is acting on behalf of a principal, whether disclosed or not by the online shop customer, the online shop customer shall be personally responsible for the performance of the contract by the principal.

Governing Law

This contract shall be governed by UK Law. These Terms and Conditions to not affect your statutory rights.

Disputes

Any dispute arising out of this contract shall be settled by arbitration in London in accordance with the rules of an appropriate trade organisation selected by us. Relax, we want you to be happy and doubt this will ever happen
